These Terms of Service ("Terms") govern your access to and use of fusionfirearms.com (the "Site") and the products and services offered by Fusion Precision Engineering LLC, doing business as "Fusion Firearms" ("Fusion Firearms," "we," "us," or "our"). By accessing the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy. Read them carefully. They include important provisions about firearms compliance, age requirements, eligibility, FFL transfer, warranty, limitations of liability, dispute resolution, governing law, and a class-action waiver. If you do not agree, do not use the Site.
1. Eligibility and age requirements
By using the Site or placing an order, you represent and warrant that:
- You are at least 21 years of age.
- You are a U.S. citizen or lawful resident physically located in the United States.
- You are not a "prohibited person" under 18 U.S.C. § 922(g) or any state or local law (including persons convicted of a felony, fugitives from justice, persons subject to certain restraining orders, persons adjudicated mentally defective, persons dishonorably discharged from the armed forces, illegal aliens, persons addicted to controlled substances, persons convicted of a misdemeanor crime of domestic violence, and others).
- You will comply with all federal, state, and local laws that apply to the purchase, possession, transfer, transport, storage, and use of firearms in your jurisdiction.
- The information you provide in connection with any order or account is truthful, accurate, and complete.
Florida law requires the buyer of any firearm to be 21 or older (Fla. Stat. § 790.065). Federal law (18 U.S.C. § 922(b)(1)) requires age 21 or older to purchase a handgun or handgun ammunition from a licensed dealer, and 18 or older to purchase a rifle, shotgun, or ammunition for a rifle or shotgun. We will not knowingly sell or transfer firearms or ammunition to anyone who does not meet these requirements.
2. No straw purchases
It is a federal crime under 18 U.S.C. § 922(a)(6) and 18 U.S.C. § 924(a) to acquire a firearm on behalf of another person who is not present at the FFL transfer or who cannot lawfully buy or possess a firearm (a "straw purchase"). By placing an order with us, you certify that you are buying the firearm for yourself or as a bona fide gift, and that you are not buying on behalf of another person. You agree to truthfully complete ATF Form 4473 at the receiving FFL.
3. Account registration
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at 941-485-2579 if you suspect unauthorized use. We may suspend, restrict, or terminate accounts that violate these Terms or applicable law, in our sole discretion.
4. Right to refuse service
We reserve the right to refuse, cancel, or limit any order, suspend or terminate any account, and refuse service to any person, in our sole discretion and at any time, including (without limitation) in cases of suspected fraud, suspected straw purchase, ineligibility under federal or state firearms law, restricted-jurisdiction issues, pricing or description errors, or violations of these Terms. If we cancel an order after payment, we will refund the amount paid; non-refundable third-party fees (such as FFL transfer fees) are not refunded by us.
5. Products, pricing, and availability
We try to keep product descriptions, photos, specifications, and prices accurate, but errors and omissions can occur. We reserve the right to correct errors, change prices, refuse or cancel orders, and limit quantities at any time, including after an order has been submitted, in our sole discretion. Photos are illustrative; actual products may vary in finish, included accessories, or other details. Custom and made-to-order items have lead times stated at checkout or in the product listing.
6. Firearms compliance and FFL transfer
Federal law requires all firearms to be shipped from a licensed dealer to a licensed dealer (FFL). We can only ship a firearm to the address printed on the receiving FFL's license. Before we ship a firearm:
- You must designate an FFL located in your state to receive the firearm.
- The receiving FFL must email or fax a current signed copy of their FFL to us, or you must authorize us to contact the FFL directly to obtain it.
- You must complete the receiving FFL's transfer process, including ATF Form 4473 and any required background check, in person at the FFL's premises.
- Local FFL transfer fees are set by your dealer and are paid by you directly to the dealer; they are not included in our prices and are not refundable through us.
If your background check is denied, the firearm will be returned to us. Restocking fees and shipping charges may apply per our Returns Policy.
We do not sell, ship, or transfer firearms or firearm parts to any jurisdiction where the specific item is prohibited. You are solely responsible for knowing the laws that apply in your state, county, and city. If you place an order for an item that cannot lawfully be transferred to your jurisdiction, we will cancel the order and refund the purchase price; any non-refundable third-party fees you paid (such as FFL transfer fees) are not refunded by us, and you must pursue any refund of those fees with the third party directly.
Magazines, suppressors, short-barreled rifles, short-barreled shotguns, machine guns, "any other weapons," and other NFA items are subject to additional federal and state laws. We sell only what we are licensed and authorized to sell. NFA items, where offered, require ATF approval and tax stamp before transfer.
7. Restricted jurisdictions and items
State, county, and city laws restrict the sale of certain firearms, parts, magazines, ammunition, and accessories. Restrictions change frequently. Restricted jurisdictions include, without limitation, California, Connecticut, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New York, Washington, Washington D.C., and certain cities including Chicago. It is your responsibility to verify legality before ordering. We reserve the right to refuse or cancel orders that we determine, in our sole discretion, cannot lawfully be shipped or transferred.
8. Orders and payment
By submitting an order, you authorize us to charge your payment method for the order total, including taxes and shipping. Your order is a request to buy. Orders are accepted only when we send an order confirmation email or ship the order, whichever is earlier. We may decline orders for any lawful reason. Sales tax is collected as required by law in jurisdictions where we have a tax obligation.
9. Shipping
See our Shipping Policy for carriers, transit times, signature requirements, FFL transfer logistics, and restricted jurisdictions. Risk of loss and title pass to you on delivery to the receiving FFL or, for non-firearm items, on delivery to the address you provided. You are responsible for providing an accurate shipping address; we are not responsible for losses caused by inaccurate or outdated address information you provide.
10. Returns, refunds, and exchanges
See our Returns Policy. In summary: most products may be returned within 60 calendar days of the original order date, undamaged and in original condition, subject to a 15% restocking fee. Once a firearm has been transferred from your FFL to you, it is considered used and cannot be returned; warranty service for Fusion-brand firearms is handled separately. Some items are non-returnable, including ammunition, used items, custom or made-to-order items, and clearance items.
11. Warranty
Fusion-brand pistols carry our lifetime workmanship guarantee against defects in materials and workmanship for the original purchaser, subject to the terms of the printed warranty card included with the firearm and any updates published on the Site. Normal wear, modification, neglect, abuse, use of reloaded or non-SAAMI-spec ammunition, unauthorized service, and damage caused by accident void the warranty. Warranty service is performed only at our facility in Venice, Florida.
Non-Fusion products carry only the warranty offered by their original manufacturer.
EXCEPT FOR THE EXPRESS WRITTEN WARRANTIES PROVIDED WITH OUR PRODUCTS, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FUSION FIREARMS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH THE SITE CREATES ANY WARRANTY NOT EXPRESSLY STATED.
12. Assumption of risk; safe handling; misuse
Firearms are inherently dangerous when misused. You acknowledge and assume all risk of injury, death, or property damage arising from the handling, storage, transport, discharge, or other use of any firearm or firearm-related product. You agree to handle firearms only in accordance with the safety practices published by the National Shooting Sports Foundation, applicable manufacturer manuals, and all federal, state, and local laws. Always treat every firearm as if it is loaded; keep your finger off the trigger until ready to fire; never point a firearm at anything you are not willing to destroy; be aware of your target and what is beyond it; store firearms securely and out of reach of unauthorized users.
Fusion Firearms is not responsible for accidental discharge, negligent handling, intentional misuse, or any injury or damage caused by the user or any third party.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FUSION FIREARMS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, BUSINESS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SITE OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the limitations above may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless Fusion Firearms, its affiliates, officers, directors, employees, and agents from any claim, demand, loss, liability, judgment, damage, or expense (including reasonable attorneys' fees and costs) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any law or regulation, including federal, state, or local firearms laws; (c) your misuse of any product; (d) any false, inaccurate, or misleading information you provide; (e) your infringement of any third party's rights.
15. Intellectual property and prohibited uses
The Site, including its design, text, graphics, logos, photos, video, audio, software, product images, descriptions, and all other content, is owned by Fusion Precision Engineering LLC or its licensors and is protected by U.S. and international intellectual property laws. "Fusion Firearms" and our logos are trademarks of Fusion Precision Engineering LLC.
You may use the Site only for its intended purpose: browsing, evaluating, and lawfully purchasing our products. You agree NOT to:
- Copy, modify, distribute, sell, license, lease, frame, mirror, or otherwise exploit the Site or its contents except as expressly allowed by these Terms or with our prior written consent.
- Use any robot, spider, scraper, crawler, or other automated means to access, collect, or extract data from the Site.
- Use the Site or its data to train, fine-tune, or develop any artificial intelligence or machine-learning model without our prior written consent.
- Reverse engineer, decompile, or attempt to discover the source code or underlying ideas of any portion of the Site.
- Bypass, disable, or interfere with security features, rate limits, CAPTCHAs, or access controls.
- Submit false, misleading, or fraudulent information, reviews, or orders.
- Buy products for resale outside the lawful FFL chain or for export from the United States.
- Use the Site or any product to violate any law, regulation, or third-party right.
- Interfere with the operation of the Site, introduce viruses or malicious code, or impose an unreasonable load on our infrastructure.
- Harvest or collect personal information about other users.
- Impersonate any person or misrepresent your affiliation with any person or entity.
Violation of this Section is grounds for immediate termination of your account and order, and may give rise to civil and criminal liability.
16. User submissions and DMCA
If you submit reviews, photos, or other content ("User Content"), you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable license to use, copy, modify, display, and distribute the User Content in connection with the Site and our marketing. You represent that you own or have the rights to the User Content and that it does not infringe any third party's rights or violate any law. We may remove User Content at any time in our sole discretion.
If you believe content on the Site infringes your copyright, send a notice that complies with 17 U.S.C. § 512(c)(3) to our designated agent at [email protected] or to the postal address in Section 27. We respond to valid DMCA notices and will terminate the accounts of repeat infringers in appropriate circumstances.
17. Site availability and modifications
We may modify, suspend, or discontinue the Site or any feature at any time, in our sole discretion, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance.
18. Third-party links and content
The Site may contain links to third-party sites or content. We do not control and are not responsible for third-party sites or content. Inclusion of a link does not imply endorsement.
19. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, flood, hurricane, earthquake, war, terrorism, civil unrest, riots, labor disputes, supply-chain disruption, carrier delays, internet or utility outages, governmental action, public health emergencies, embargoes, or regulatory changes.
20. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. Any dispute arising out of or relating to these Terms, the Site, or any product will be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to the personal jurisdiction and venue of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
21. Dispute resolution; class-action waiver
You and Fusion Firearms agree to first attempt to resolve any dispute informally by contacting us at [email protected] with a written description. If we cannot resolve it within sixty (60) days, either party may pursue the dispute in the courts identified in Section 20.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FUSION FIREARMS EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, REPRESENTATIVE ACTION, OR PRIVATE ATTORNEY GENERAL ACTION. DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY.
22. Statute of limitations
To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms, the Site, or any product must be filed within one (1) year after the claim or cause of action arose; otherwise it is permanently barred.
23. Attorneys' fees
If we prevail in any action to enforce these Terms, we are entitled to recover our reasonable attorneys' fees and costs from you, to the fullest extent permitted by law.
24. Termination
You may stop using the Site at any time. We may suspend or terminate your access, account, or order in our sole discretion, with or without cause and with or without notice. Sections that by their nature should survive termination (including Sections 11 through 16, 18 through 23, and 25) will survive.
25. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, Returns Policy, Shipping Policy, and any policies referenced on the Site, are the entire agreement between you and Fusion Firearms regarding the Site and supersede any prior agreements on the same subject matter.
- Severability. If any provision is held unenforceable, that provision will be modified to the minimum extent needed to make it enforceable, or, if not possible, severed; the remainder will continue in full force.
- No waiver. Our failure or delay in enforcing any provision is not a waiver of that or any other provision.
- Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time, including to a successor in connection with a merger, acquisition, or sale of assets.
- Notices to you. We may give notices by email to the address on your account, by posting on the Site, or by any other reasonable means.
- Notices to us. Legal notices to us must be sent to the postal address in Section 27 with a copy by email to [email protected].
- Headings. Section headings are for convenience only and do not affect interpretation.
- Reformation. If any limitation of liability or warranty disclaimer is held unenforceable, it will be reformed to the maximum extent permitted by law.
- Independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
- No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
26. Changes to these Terms
We may update these Terms from time to time in our sole discretion. The "Last updated" and "Effective date" at the top will reflect changes. Material changes will be communicated through the Site or by email where required. Your continued use of the Site or placement of any order after changes take effect constitutes acceptance of the updated Terms.
