These Terms of Service ("Terms") govern your use of fusionfirearms.com and the products and services offered by Fusion Firearms. By using the site or placing an order, you agree to these Terms.

Eligibility

To use this site and purchase from Fusion Firearms you must:

  • Be at least 18 years old. Handguns may only be purchased by individuals 21 years of age or older.
  • Be legally permitted under federal, state, and local law to own and possess the products you are ordering.
  • Provide accurate, current, and complete information.
  • For firearm purchases, designate a valid Federal Firearms Licensee (FFL) to receive the firearm and complete a background check.

You are responsible for understanding and complying with the firearms laws in your state and locality. Some products may not be sold or shipped to certain states.

Your account

You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately if you believe your account has been compromised.

Products, pricing, and availability

We do our best to keep product information, pricing, and availability accurate, but errors can occur. We reserve the right to correct any error, change prices, and refuse or cancel any order — including orders that have been confirmed — if we discover a pricing or product error or suspect fraudulent activity. If we cancel an order you have already paid for, we will issue a full refund to your original payment method.

Ordering and payment

Placing an order is an offer to buy; the order is confirmed when we accept payment and send a confirmation email. Card information is processed by our PCI-compliant payment processor (Authorize.Net) and is not stored on our servers. We accept the payment methods displayed at checkout.

Shipping

See our Shipping Policy for details. Firearms are shipped only to a valid Federal Firearms Licensee for transfer. Parts, accessories, sights, and gunsmithing services may be shipped directly to you. We currently ship within the United States only.

Returns and refunds

Our return process and timing are described in the Returns Policy. Special rules apply to firearm returns and custom-shop work.

Warranty and disclaimers

Fusion Firearms stands behind the workmanship of our products and services with a lifetime workmanship guarantee covering defects in materials and workmanship under normal use. The guarantee does not cover damage caused by abuse, neglect, unauthorized modification, improper maintenance, or use of non-factory ammunition or parts.

Except for the lifetime workmanship guarantee, products and services are provided "as is". To the maximum extent permitted by law, Fusion Firearms disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose.

Firearms safety: firearms are inherently dangerous. You assume all risk of injury or damage arising from the use, possession, storage, or transfer of any product purchased from Fusion Firearms. Always handle firearms responsibly, keep them secured and away from unauthorized users (including children), and follow the laws of your jurisdiction.

Limitation of liability

To the maximum extent permitted by law, Fusion Firearms and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the site, products, or services, even if advised of the possibility of such damages. Our total aggregate liability for any claim shall not exceed the amount you paid us for the product or service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold Fusion Firearms harmless from any claims, damages, costs, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your use of any product purchased from us, or your violation of any law or regulation in connection with such use.

Intellectual property

All content on this site — text, images, logos, product designs, code — is the property of Fusion Firearms or its licensors and is protected by copyright, trademark, and other laws. You may not use, copy, reproduce, distribute, or create derivative works from any part of the site without our prior written consent.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the site shall be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they were last revised. Continued use of the site after changes are posted means you accept the updated Terms.
