This Privacy Policy describes how Fusion Precision Engineering LLC, doing business as "Fusion Firearms" ("Fusion Firearms," "we," "us," or "our"), collects, uses, discloses, and protects personal information when you visit fusionfirearms.com (the "Site") or buy products and services from us. Because we sell firearms, firearm parts, and ammunition, some of the information we collect is governed by federal and state firearms laws in addition to general consumer privacy laws.

By using the Site or providing information to us, you agree to this Privacy Policy. If you do not agree, do not use the Site.

2. Information we collect

We collect the following categories of personal information.

2.1 Information you give us directly

  • Identifiers: name, billing and shipping address, email, phone, account username and password.
  • Commercial information: products purchased, order history, returns and warranty claims.
  • Payment information: credit card or other payment details. Full card numbers are not stored on our servers; payments are processed through PCI-DSS compliant third-party processors.
  • Federal Firearms License (FFL) information: the name, address, phone, and license number of the FFL dealer you designate to receive your firearm.
  • Identity verification documents: when required by federal or state law (for example, dealer applications, warranty service involving an FFL, or fraud screening), we may request a copy of a government-issued photo ID, signed FFL, or similar document.
  • Communications: messages, voicemails, support tickets, reviews, and any information you provide when you contact us or post content on the Site.
  • Marketing preferences: email and SMS opt-ins and preferences set in your account.

2.2 Information collected automatically

  • Internet and device activity: IP address, browser type, operating system, referring URL, pages visited, links clicked, session duration, time stamps.
  • Cookies and similar technologies: see Section 5.
  • Behavioral analytics: products viewed, items added to cart, abandoned carts, completed orders.
  • Approximate location: derived from IP address.

2.3 Information from third parties

  • Payment processors: fraud-screening results and payment confirmation.
  • FFL verification: we may verify the validity of an FFL with the issuing dealer or, where appropriate, the ATF eFFL system.
  • Marketing partners and advertising platforms: aggregated audience data and campaign performance.
  • Public records and fraud-prevention services: to verify identity and detect fraud.

2.4 Sensitive personal information

For purposes of state privacy laws (including the California Consumer Privacy Act as amended by the California Privacy Rights Act), some information we collect may qualify as "sensitive personal information," including account log-in credentials, government-issued identifiers, and FFL information collected for compliance purposes. We use sensitive personal information only for the purposes for which it was collected (such as completing a transaction, complying with firearms laws, providing customer support, and detecting fraud) and not for inferring characteristics about you.

3. How we use information

We use personal information for the following business purposes:

  • Process and fulfill orders, including coordinating FFL transfers required by federal law.
  • Provide customer service, warranty service, and respond to communications.
  • Verify identity and eligibility under federal and state firearms laws (including age verification, FFL validity, and restricted-jurisdiction screening).
  • Comply with our recordkeeping obligations under the Gun Control Act, ATF regulations, and applicable state firearms laws.
  • Detect, investigate, and prevent fraud, abuse, and security incidents.
  • Operate, maintain, and improve the Site, our products, and our services.
  • Send transactional communications (order confirmations, shipping notices, warranty updates, recall notices).
  • Send marketing communications you have opted in to receive.
  • Comply with legal process, court orders, and lawful government requests.
  • Enforce our Terms of Service and protect our rights, property, or safety, or the rights, property, or safety of others.

4. Disclosure of personal information

We do not "sell" or "share" personal information as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA) or any other state privacy law.

We disclose personal information only as described below:

  • FFL dealers: when you purchase a serialized firearm or frame, we disclose your name and order details to the FFL dealer you designate. This is required by federal law.
  • Service providers: hosting, payment processing, fraud screening, shipping carriers (FedEx, UPS), email and SMS delivery, customer support tools, accounting, and analytics. Service providers act on our instructions under written contract and may not use your information for their own purposes.
  • Government, law enforcement, and regulators: when required by law, regulation, court order, subpoena, or to respond to a lawful request from the ATF, federal, state, or local authorities.
  • Professional advisors: attorneys, accountants, and auditors, under duties of confidentiality.
  • Successors: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred subject to standard confidentiality protections.
  • With your consent: in any other case, only with your consent.

5. Cookies, pixels, and tracking technologies

We use cookies, pixels, tags, and similar technologies to operate the Site, remember preferences, analyze usage, and support marketing. Categories include:

  • Strictly necessary: required for cart, checkout, authentication, and security.
  • Functional: remember preferences and settings.
  • Analytics: measure traffic and behavior to improve the Site.
  • Marketing: deliver and measure advertising on third-party platforms.

You can manage non-essential cookies at any time using the cookie banner on our Site, which is powered by CookieYes. Most browsers also let you block or delete cookies through their settings. Blocking strictly necessary cookies will prevent the Site from functioning correctly.

Do Not Track and Global Privacy Control

Our Site does not currently respond to "Do Not Track" browser signals because no industry-standard mechanism exists for honoring them. Where required by law (for example, California), we treat a clearly communicated Global Privacy Control (GPC) signal as a request to opt out of any sale or sharing of personal information for cross-context behavioral advertising. We do not sell or share for behavioral advertising.

6. Data retention

We retain personal information for the time necessary to fulfill the purposes for which it was collected, comply with legal and regulatory obligations, resolve disputes, and enforce our agreements. Typical retention periods include:

  • Order, transaction, and tax records: at least seven (7) years to satisfy tax, accounting, and consumer-protection record obligations.
  • Firearms-related records held by us: for the period required by applicable federal and state law.
  • Customer service communications: typically up to three (3) years after the last contact.
  • Marketing data: until you opt out, or for the period required by law, whichever is shorter.
  • Account records: for the life of the account plus the period required to address legal claims, tax records, and ongoing warranty obligations.
  • Server logs and analytics: typically up to two (2) years.

When we no longer need personal information, we delete or de-identify it.

7. Your rights and choices

Depending on where you live, you may have the following rights with respect to your personal information:

  • Right to know / access: request confirmation of whether we process your information and a copy of it.
  • Right to correct: request that we correct inaccurate information.
  • Right to delete: request that we delete personal information, subject to legal exceptions. We are not required to delete information we are obligated to retain (for example, transaction and firearms-compliance records) or that we need to detect security incidents, debug, comply with legal obligations, complete a transaction, or exercise free speech.
  • Right to data portability: request your information in a portable format.
  • Right to opt out of sale or sharing for cross-context behavioral advertising: we do not sell or share for behavioral advertising. To opt out of marketing emails, click the unsubscribe link in any marketing email. To stop SMS, reply STOP. To opt out of marketing cookies, use our cookie banner.
  • Right to limit use of sensitive personal information: we use sensitive personal information only for the limited purposes described in Section 2.4.
  • Right against automated decision-making: we do not use solely automated decision-making with legal or similarly significant effects on you.
  • Right to non-discrimination: we will not discriminate against you for exercising your privacy rights.

To exercise any of these rights, contact us at customersupport@fusionfirearms.com or 941-485-2579. We may need to verify your identity before processing the request. An authorized agent may submit a request on your behalf with proof of authorization.

If you live in California, Colorado, Connecticut, Virginia, Utah, or another state with comprehensive privacy laws, we will respond within the time required by your state's law. If we deny a request, you have the right to appeal by contacting us at the same address.

8. Data security

We use administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption in transit, encryption of sensitive data at rest where appropriate, role-based access controls, audit logging, and reputable PCI-DSS compliant payment processors. No system is perfectly secure, and we cannot guarantee the security of any information you transmit to us. If you believe your account has been compromised, contact us immediately at 941-485-2579.

9. Data breach notification

If a breach of unencrypted personal information occurs that is reasonably likely to result in harm to you, we will notify you and applicable authorities as required by law, without unreasonable delay, and through the contact methods you have provided.

10. Children

The Site is not intended for and is not directed to children under 18. We do not knowingly collect personal information from anyone under 13 in violation of the Children's Online Privacy Protection Act (COPPA). Federal law (18 U.S.C. § 922(b)(1)) restricts the sale of handguns and handgun ammunition to persons 21 or older, and the sale of rifles, shotguns, and ammunition for rifles or shotguns to persons 18 or older. Florida law requires the buyer of any firearm to be 21 or older. We do not knowingly sell to or collect information from minors who do not meet these requirements. If you believe a child has provided us information, contact us at customersupport@fusionfirearms.com and we will delete it.

11. Third-party links and services

The Site may contain links to third-party websites, services, or content (for example, payment processors, social media, embedded videos, FFL dealer locators). We do not control and are not responsible for the privacy practices of third parties. Read the privacy policy of any third-party site you visit. Inclusion of a link does not imply endorsement.

12. International users

Fusion Firearms operates in the United States and sells products only to customers in the United States. We do not ship internationally. If you access the Site from outside the U.S., your information will be transferred to and processed in the United States, which may not provide the same level of data protection as your home country.

13. State-specific notices

California residents. Categories of personal information collected, sources, business purposes, and recipients are described in Sections 2 through 4. We do not sell or share personal information for cross-context behavioral advertising. We retain personal information for the periods described in Section 6. You may exercise the rights described in Section 7 by contacting us at customersupport@fusionfirearms.com. You may designate an authorized agent to act on your behalf.

Nevada residents. We do not sell personal information as defined under Nevada law. To submit a verified request not to sell, contact us at customersupport@fusionfirearms.com.

Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Delaware, New Jersey, New Hampshire, Maryland, Minnesota, and other state residents with comprehensive consumer privacy laws. You have the rights described in Section 7. Contact customersupport@fusionfirearms.com to exercise them. Where your state's law requires it, we will respond within the deadline that law sets and provide an appeal process if we deny your request.

Florida residents. You have the rights described in Section 7. Florida is the state of our principal place of business and the governing-law jurisdiction for this Policy.

14. Changes to this Policy

We may update this Privacy Policy from time to time in our sole discretion. The "Last updated" and "Effective date" at the top will reflect the most recent changes. Material changes will be communicated through the Site or by email where required by law. Continued use of the Site after changes take effect means you accept the updated Policy.
